This website is operated by Haute Candles LLC ("Haute Candles," "we," "us," or "our"). These Terms of Service govern your access to and use of hautecandles.com, including any purchases made through the website.

By visiting our website or purchasing from us, you agree to these Terms of Service and to any additional policies referenced here, including our Refund Policy, Privacy Policy, Shipping Policy, and applicable product care and safety instructions. If you do not agree to these terms, please do not use the website.

Our store is hosted by Shopify, which provides the ecommerce platform that allows us to sell our products and services to you.

1. Eligibility and Account Information

By using this website, you represent that you are at least the age of majority in your state or place of residence, or that you have permission from a parent or legal guardian.

You agree to provide current, complete, and accurate information when placing an order and to promptly update information needed to complete your transaction. You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.

2. Products and Handmade Variations

Haute Candles products are made in small batches. Natural and handcrafted products may vary slightly in color, texture, finish, fragrance character, or appearance from photographs or from one batch to another. These normal variations do not affect the intended use of the product and are not necessarily defects.

We make reasonable efforts to display product colors and images accurately, but we cannot guarantee that your device will reproduce colors exactly. Product descriptions, sizes, availability, and packaging may be updated from time to time.

Fragrance perception is subjective and can vary by person, environment, room size, temperature, airflow, and product use. We do not guarantee that every fragrance will appeal to every customer or perform identically in every setting.

3. Product Use and Safety

You agree to read and follow all warnings, labels, care instructions, and usage directions supplied with a product or made available on our website.

Never leave a burning candle unattended. Keep burning candles away from children, pets, drafts, vibrations, and combustible materials. Place candles on a stable, heat-resistant surface, trim the wick as directed, and do not burn a candle for longer than the recommended time. Discontinue use if the container is cracked or damaged, the flame becomes unusually high or unstable, or approximately one-half inch of wax remains at the bottom of the container.

Fragrance products are intended only for their labeled use. Do not ingest them. Keep products away from children and pets, and avoid contact with eyes and other sensitive areas. Products intended for use on the skin should be patch-tested before broader use and discontinued if irritation occurs. Home-fragrance oils, diffuser oils, room sprays, and wax-melt products are not body products unless expressly labeled otherwise.

Improper use, alteration, storage, or handling may damage products or property and may cause injury. To the fullest extent permitted by law, Haute Candles is not responsible for harm resulting from use contrary to the product label, warnings, instructions, or intended purpose.

4. Orders and Acceptance

Submitting an order does not guarantee acceptance. We reserve the right to accept, decline, limit, or cancel an order for legitimate reasons, including product unavailability, suspected fraud, pricing or listing errors, resale activity, or violations of these Terms.

If we cancel an order after payment has been collected, we will refund the cancelled amount to the original payment method. We may limit quantities purchased per person, household, account, payment method, or order.

Products purchased through the retail website are intended for personal use and not for unauthorized resale. Wholesale purchases may be subject to separate terms.

5. Prices, Payments, and Billing

Prices are shown in U.S. dollars unless otherwise stated and may change without notice. Taxes, shipping charges, and other applicable fees will be shown during checkout when required.

We reserve the right to correct typographical errors, inaccurate descriptions, promotions, availability information, or pricing mistakes. If a material error affects an order you have already placed, we may contact you for instructions or cancel and refund the affected item.

You represent that you are authorized to use the payment method submitted with your order and agree to pay all charges associated with your purchase.

6. Shipping, Delivery, Returns, and Refunds

Processing and delivery estimates are estimates rather than guarantees. Delays may occur because of weather, carrier operations, high order volume, holidays, product temperatures, address problems, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address and for monitoring tracking information. Risk of loss and responsibility for a shipment are governed by applicable law; nothing in these Terms limits rights that cannot legally be waived.

Returns, refunds, damaged shipments, order cancellations, and returned packages are handled according to our Refund Policy and Shipping Policy, which are incorporated into these Terms.

7. Promotions, Discounts, and Gift Cards

Promotions and discount codes are subject to their stated conditions and expiration dates. Unless expressly stated otherwise, discounts cannot be combined, applied retroactively, redeemed for cash, or used toward previous purchases. We may modify or end a promotion when permitted by law.

Gift cards are subject to applicable law and any terms shown at purchase. Gift cards are not redeemable for cash except where required by law.

8. Intellectual Property

All website content—including text, photographs, graphics, logos, product names, fragrance names, designs, and other original material—is owned by or licensed to Haute Candles and is protected by applicable intellectual-property laws.

You may use the website for personal, noncommercial shopping purposes. You may not copy, reproduce, republish, sell, exploit, or create derivative works from our content without prior written permission, except as permitted by law.

9. Reviews, Feedback, and Other Submissions

If you submit a review, photograph, suggestion, comment, or other content, you represent that you have the right to submit it and that it is truthful, lawful, and does not violate another person's rights.

You grant Haute Candles a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display content you voluntarily submit in connection with our business and marketing. We are not required to publish or retain submissions and may remove content that is unlawful, misleading, abusive, or unrelated.

Please do not submit confidential information, proprietary ideas, or content you do not want us to use.
